The American Recovery and Reinvestment Act of 2009 (ARRA) includes a section that expands the reach of the Health Insurance Portability and Accountability Act (HIPAA) and introduces the first federally mandated data breach notification requirement.

Under the Health Information Technology for Economic and Clinical Health Act (HITECH Act) data privacy and security requirements are expanded to include the "business associates" of those entities that are subject to HIPAA. Business associates are now subject to the same civil and criminal penalties that hospitals, pharmacies and other HIPAA-covered entities face for violations.

More than 90 percent of health care companies are not ready to comply with the privacy and security provisions of the HITECH Act, according to a survey conducted by the Ponemon Institute. Is your company one of them?
